Terms of Service

1. Agreement to Terms

By accessing and using CrystalGrid's lead generation services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Services

CrystalGrid provides advanced lead generation technology and services designed to help businesses identify, target, and acquire qualified leads through various digital marketing channels including:

  • Social media advertising and targeting
  • Search engine marketing and optimization
  • Premium display advertising networks
  • Lead qualification and scoring systems
  • Automated outreach and follow-up systems

3. Service Tiers and Pricing

3.1 Pricing Structure

CrystalGrid operates on a performance-based pricing model with the following tiers:

  • Social Media Leads: $40 per qualified lead generated through social media platforms
  • Search Engine Leads: $50 per qualified lead generated through search engine marketing
  • Premium Display Leads: $60 per qualified lead generated through premium display advertising networks

3.2 Lead Qualification Criteria

A "qualified lead" is defined as a potential customer who meets the following criteria:

  • Demonstrates genuine interest in your products or services
  • Provides accurate contact information
  • Meets your specified demographic and geographic requirements
  • Has the authority or influence to make purchasing decisions
  • Responds to initial contact attempts within 30 days

4. Client Responsibilities

4.1 Information Accuracy

Clients must provide accurate, complete, and up-to-date information about their business, target audience, and service requirements.

4.2 Compliance

Clients must ensure their business practices comply with all applicable laws, regulations, and industry standards, including but not limited to:

  • CAN-SPAM Act and email marketing regulations
  • Telephone Consumer Protection Act (TCPA)
  • General Data Protection Regulation (GDPR) where applicable
  • California Consumer Privacy Act (CCPA)

5. Service Level Agreements

5.1 Lead Delivery

CrystalGrid commits to delivering qualified leads within the agreed timeframe, typically within 30-90 days of campaign launch, depending on industry and target specifications.

5.2 Quality Assurance

All leads undergo our proprietary qualification process before delivery. We guarantee that delivered leads meet the specified criteria or provide replacement leads at no additional cost.

6. Payment Terms

6.1 Billing

Clients are billed monthly for qualified leads delivered during the previous billing period. Payment is due within 30 days of invoice date.

6.2 Disputes

Lead quality disputes must be reported within 15 days of delivery. CrystalGrid will investigate all disputes and provide resolution within 10 business days.

7. Intellectual Property

CrystalGrid retains all rights to its proprietary technology, algorithms, and methodologies. Clients receive a limited license to use delivered leads for their business purposes only.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the business relationship, including but not limited to:

  • Lead generation strategies and methodologies
  • Client business information and requirements
  • Pricing and contract terms
  • Performance metrics and results

9. Data Protection and Privacy

CrystalGrid is committed to protecting personal data and privacy. Our data handling practices are detailed in our Privacy Policy, which forms an integral part of these terms.

10. Limitation of Liability

CrystalGrid's liability is limited to the amount paid by the client for services in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

11. Termination

11.1 Termination by Client

Clients may terminate services with 30 days written notice. Outstanding invoices remain due and payable.

11.2 Termination by CrystalGrid

CrystalGrid may terminate services immediately for breach of terms, non-payment, or illegal activities.

12. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including natural disasters, government actions, or technical failures of third-party platforms.

13. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Harris County, Texas.

14. Modifications

CrystalGrid reserves the right to modify these terms at any time. Clients will be notified of material changes with 30 days advance notice.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between the parties and supersede all prior agreements and understandings.
